1. Operator Identity

SplitFast is operated as an independent project. Our infrastructure is hosted in the European Union (Frankfurt, Germany) via DigitalOcean.

2. Acceptance of Terms

By accessing or using SplitFast ("the Service"), you agree to be bound by these Terms of Service ("Terms").

These Terms constitute a legally binding agreement between you and SplitFast.

3. Description of Service

SplitFast is a Telegram Mini-App that allows users to:

  • Track shared expenses within Telegram groups
  • Split bills among group members (equally, by portions, or by items)
  • Calculate and track balances and debts
  • Record settlements between group members
  • Store payment method information for easy settlement
  • Scan receipts to automatically extract expense data (premium feature)
  • Convert currencies using third-party exchange rate data

Important: SplitFast does not hold or move money, process payments, or provide any regulated financial services.

4. Financial Disclaimer

SplitFast is not a financial institution and does not provide financial, tax, legal, or investment advice. All balance calculations are for informational purposes only.

You should:

  • Verify all calculations independently before making financial decisions
  • Not rely solely on SplitFast data for tax, legal, or accounting purposes
  • Resolve disputes with group members directly

Currency conversion rates are obtained from third-party APIs and may not reflect real-time market rates.

5. Eligibility

To use SplitFast, you must:

  • Be at least 16 years of age
  • Have a valid Telegram account
  • Agree to Telegram's Terms of Service
  • Have the legal capacity to enter into these Terms

6. User Accounts & Telegram Dependency

SplitFast uses Telegram's authentication mechanism. By using our Service:

  • Your account is linked to your Telegram identity
  • You are responsible for maintaining the security of your Telegram account
  • Activities under your account are your responsibility
  • We are not responsible for Telegram's availability or policies

7. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose, including fraud or money laundering
  • Submit false, fraudulent, or misleading expense information
  • Attempt to access other users' data without authorization
  • Interfere with or disrupt the Service or its infrastructure
  • Use automated systems (bots, scrapers) to access the Service without permission
  • Reverse engineer, decompile, or attempt to extract source code
  • Use the Service to harass, abuse, or harm others
  • Circumvent any security measures or access restrictions
  • Introduce malicious code, viruses, or other harmful content
  • Store sensitive personal data beyond what is reasonably necessary

8. Premium Features and Payments

8.1 Premium Options

SplitFast offers premium features through Telegram Stars:

  • Premium Subscription: Monthly or yearly subscription for individual users
  • Supergroup Upgrade: One-time purchase that unlocks premium features for an entire group

8.2 Payment Processing

  • All payments are processed through Telegram Stars
  • Prices are displayed in Telegram Stars before purchase
  • Monthly subscriptions auto-renew unless cancelled through Telegram
  • Yearly subscriptions and supergroup upgrades are one-time payments

8.3 Refund Policy

Refund requests are handled on a case-by-case basis:

  • Contact us within 14 days of purchase for refund consideration
  • Refunds may be issued for technical issues preventing service use
  • Refunds are processed through Telegram's payment system
  • To request a refund, contact @splitfast on Telegram

9. User Content

9.1 Your Content

You retain ownership of content you create (expense descriptions, notes, uploaded images). By using the Service, you grant us a license to:

  • Store and process your content to provide the Service
  • Display your content to authorized group members
  • Create backups of your content for data protection purposes

9.2 Content Responsibility

You are responsible for ensuring that:

  • Information you provide is accurate and not misleading
  • You have the right to share any third-party personal data
  • Content does not violate any applicable laws or third-party rights

9.3 Content Visibility

Expenses, splits, settlements, and balances you create are visible to all members of the same group.

9.4 Receipt Images

When you upload receipt images, they are stored on our servers and remain accessible to group members.

10. Third-Party Services

SplitFast relies on third-party services to function. We are not responsible for:

  • Telegram: Availability, policies, or actions of the Telegram platform
  • Exchange Rate APIs: Accuracy or availability of currency conversion rates
  • Payment Services: Any third-party payment methods you use to settle debts
  • Cloud Services: Our infrastructure providers (DigitalOcean, Google Cloud)

We make reasonable efforts to select reliable partners, but cannot guarantee uninterrupted operation.

11. Privacy

Your use of the Service is governed by our Privacy Policy, which describes how we collect, use, and protect your information.

12. Intellectual Property

The Service, including its design, features, and functionality, is owned by SplitFast. You may not:

  • Copy, modify, or distribute the Service
  • Use our trademarks or branding without permission
  • Create derivative works based on the Service

13. Service Availability

The Service is provided "as is" and "as available." We may:

  • Modify, suspend, or discontinue features without prior notice
  • Perform maintenance that temporarily affects availability
  • Limit access in certain regions or to certain users

We do not guarantee uninterrupted or error-free operation.

14. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We specifically disclaim:

  • Warranties of merchantability or fitness for a particular purpose
  • Guarantees of uninterrupted or error-free service
  • Warranties regarding accuracy of calculations or currency conversions
  • Warranties of compatibility with all devices or Telegram versions
  • Warranties regarding third-party services or APIs

While we strive for accuracy, you should verify important financial information independently.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPLITFAST SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, business opportunities, or goodwill
  • Disputes between group members regarding expenses or debts
  • Errors in expense calculations, splits, or currency conversions
  • Financial decisions made based on Service data
  • Actions of other users or third parties
  • Service interruptions, data loss, or security breaches beyond our control

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

16. Indemnification

You agree to indemnify and hold harmless SplitFast from any claims arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you submit to the Service

17. Modifications to Terms

We may update these Terms from time to time. Changes become effective upon posting to our website.

For significant changes, we will provide reasonable notice before they take effect.

18. Termination

18.1 Termination by You

You may stop using the Service at any time. To delete your data, contact us at @splitfast.

18.2 Termination by Us

We may terminate or suspend your access:

  • For violation of these Terms
  • For illegal or harmful activities
  • For extended periods of inactivity
  • If required by law

18.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately.

19. Governing Law & Dispute Resolution

These Terms shall be governed by the laws of Germany, without regard to conflict of law principles.

For EU/EEA consumers: Nothing in these Terms affects your mandatory consumer protection rights.

If you have a dispute regarding the Service:

  • First, contact us at @splitfast to attempt informal resolution
  • We will work in good faith to resolve disputes within 30 days
  • If informal resolution fails, disputes may be brought before the competent courts

20. General Provisions

20.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and SplitFast.

20.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force.

20.3 Waiver

Our failure to enforce any provision does not constitute a waiver of that provision.

20.4 Assignment

You may not assign your rights under these Terms. We may assign our rights without restriction.
